Scope of application and agreement to the terms

These are the terms and conditions ("Terms") for the purchase of products through the website www.nomufashion.com ("Webshop") operated by Nomu Kidswear Oy ("NOMU") between NOMU and the customer ("Customer"). By accessing or using our webshop, you agree to comply with these terms. Therefore, the Webshop user ("user") should carefully review these Terms before using the Webshop. If you do not agree to these Terms, please do not use our Webshop.

NOMU reserves the right to update these Terms at any time. Updated Terms will apply to orders placed after the effective date of the new Terms. By placing an order, the Customer accepts these Terms and agrees to comply with them in their entirety, including the use of personal data and cookies in accordance with Nomu's privacy and cookie policies.

Please note that in addition to the rights specified in these Terms, you may have other rights under applicable laws, which may vary by country.

In these Terms, when referring to a product ("Product"), it means a product available in the Webshop or ordered from the Webshop.

2.  Shopping and Registration in the Webshop


All individuals aged at least 18 years with a permanent delivery address, a valid email address, and who order products within the Webshop's delivery area can shop in the Webshop.

The Customers must provide accurate information when shopping in the Webshop. The Customer is responsible for the accuracy of the information provided and must promptly inform Nomu of any changes to the information. The Customer must be the legal owner of the bank/credit card used for the purchase.

To order from the Webshop, the Customer must provide their name, address, phone number, payment details, and other information required for the purchase.

After placing an order, the Customer will receive a payment confirmation and an order confirmation by email, which will include the order number and the ordered products. The Customer will also receive a delivery confirmation by email when the order is dispatched. If all ordered products cannot be shipped in the same delivery, Customer service will contact the Customer primarily by email. There will be no additional costs for the Customer if ordered products have to be sent in multiple shipments.

The Customer has the right to cancel their order free of charge before receiving the delivery confirmation by contacting customer service via email hello@nomufashion.com.

For returns after receiving the delivery confirmation, please refer to the Cancellation Policy section.

Customers can choose to register as a customer in the Webshop to streamline their shopping experience. Registration is free and can be done with a valid email address and a password of the Customer's choice. The Customer is responsible for keeping their password secure and confidential and is responsible for all transactions made with their user account ("Customer Account") in the Webshop. The Customer must immediately contact NOMU if they suspect or become aware that their account has been compromised or used improperly. NOMU has the right to freeze or close the Customer's account if NOMU detects misuse of the Customer Account.

Customer's personal data will be processed in accordance with the privacy policy. Personal data and payment information will be processed using encrypted connections.

3. Customer-Generated Content in the Webshop


The Customer agrees not to provide or transmit any content to the Webshop that is illegal, unethical, or otherwise inappropriate, violates the rights of third parties, or unlawfully promotes third-party products or services.

The Customer may only submit, send, or publish content to the Webshop for which they have unlimited rights, including the right to transfer the content to NOMU and grant NOMU the right to publish and use the Customer's content without compensation for the purpose for which it was collected.

NOMU does not review Customer-generated content in advance and is not responsible for it in any way. NOMU reserves the right, at its discretion and without prior notice, to remove user-generated content that it deems to be in violation of these Terms or harmful to NOMU or third parties, or to modify content for purposes such as correcting typographical errors. Anyone can request the removal of content submitted to the Webshop by contacting NOMU Customer Service, and NOMU will decide whether to comply with such a request.

Customer and Consumer Protection


The relationship between the customer and NOMU is governed by these Terms and the current customer protection legislation. For the purpose of customer protection, it is not relevant whether the customer has been registered or not.

The relationship between a company customer and NOMU is primarily governed by these Terms and, secondly, current trading legislation.


4 .Product Information and Product Availability


NOMU aims to provide timely and accurate information about the product and its availability in the online store, but cannot guarantee the accuracy of the information or the availability or sufficiency of the products. Some products are manufactured in limited quantities or may be temporarily out of stock. Product images may not always accurately represent the appearance of the product, and the technical specifications, availability, and price of the product may change without prior notice. There may be variations in shades among products, and Nomu cannot guarantee that product images are always accurate under all display settings.

The availability of the product in the online store can be confirmed on the product information page. The availability of the product is also indicated in the shopping cart and order confirmation. If a product is out of stock at the time of ordering, the customer can choose to cancel the entire order or request an alternative product if available. 5.  Prices, Payment Methods, and Payment Terms


The stated prices are applicable only to orders placed in the Webshop. All prices displayed in the Webshop are the full retail prices of the Products. Prices include VAT, or other applicable taxes per country. Prices do not include shipping costs. Shipping costs per order are displayed at the check-out, when the Customer chooses the delivery method. Nomu reserves the right to change prices and shipping costs in such a way that such changes are only applied to orders made after the changes become effective. Prices are given in Euros.

NOMU reserves the right to cancel the Customer’s order, when there is an obvious and acute price error on the ordered product. This means a possible Product pricing error in the Webshop such that the Product price differs significantly from the general price level of similar Products where it is obvious to the average Customer that the price must be an error. Obvious price errors, for example, are a missing price or one given as €0.00, or if the Product’s displayed price is too low compared to the general conception of an applicable product price.


Our payment service facilitators and providers are Paytrail Plc, and PayPal in co-operation with Finnish banks and lenders. Payment service providers are third parties, with whom NOMU has entered into a contract. The Customer enters all credit card or internet bank payment details on the bank or payment service provider’s site. NOMU uses an encrypted SSL-connection for telecommunication connections.

Nomu accepts the following payment methods in the Webshop: Credit card (Visa, MasterCard, American Express), Apple Pay, ShopPay and PayPal. Nomu reserves the right to change the accepted payment methods at any time. Nomu may also request additional information for payment security.

If the Customer chooses to pay by credit card, the Customer will be redirected to the payment service provider's payment page. Payment will be deducted from the Customer's bank or credit card account when the order is confirmed. The order confirmation will be sent to the Customer by email. The order is binding for Nomu when the Customer receives the order confirmation.

Payment Service Provider

Paytrail Plc acts as a collecting payment service provider and is an authorized Payment Institution. Paytrail Plc will be shown as the recipient on your bank or credit card statement. Paytrail Plc will forward the payment to the merchant. For reclamations, please contact the website the payment was made to.

PayPal

When you choose to pay via PayPal, you are directed to the PayPal website after making an order. If you are already a PayPal customer, you can login with your credentials and verify the payment. If you are a new PayPal customer, you can open a PayPal account and verify the payment afterwards.

After your payment has been registered with us, your order will be processed by NOMU. After the payment is complete, you will receive an order verification in your email. Please note, that handling errors may occur on the PayPal site occasionally, for which NOMU cannot accept any liability.

If you are returning an Order that was paid via PayPal, we will credit the sum directly to your PayPal account. You can read more about returns in chapter 6. PayPal Terms and Conditions can be found  here.

Internet banks

The Customer can pay for purchased goods using the internet payment buttons. When the Customer uses an internet bank as the payment method, the Customer will be transferred temporarily from the Webshop to the internet bank or the NOMU partner’s (Paytrail Plc) website, and pays for the chosen Products directly from his/her bank account. The transaction is visible on the bank statement, and the payment receiver is Paytrail Plc, who remits the payment.


  1. Order Confirmation and Contract Formation


The Customer will receive an order confirmation by email once the order is placed. The order confirmation includes the ordered products, the total price of the order, and the delivery and payment methods. The order confirmation is not a guarantee of product availability.

The contract between the Customer and NOMU is formed when the Customer receives the order confirmation by email.

NOMU reserves the right to cancel the order in part or in full if the ordered product is no longer available or if there are errors in the product information, including price errors. In such cases, NOMU will inform the Customer and refund any payments made.

7. Shipping costs and methods

Shipping Costs

Shipping costs vary depending on the delivery method and destination. The Customer can choose the delivery method and see the cost at the time of purchase. Additional costs may apply for special delivery requests.

We offer free delivery in Europe for orders over 150 € and in North America for orders over 300€.

Shipping time

We aim to ensure that you receive your order as quickly as possible. Once it is on its way to you, you will receive tracking info, along with the info of an estimated delivery date, via email. You should receive your order 1-5 business days thereafter. Packages are not transported on weekends and local public holidays.

Kindly note that the estimated delivery times (1-5 business days) are estimates and may vary due to external factors outside of NOMU's, and its courier's control. These factors may include but are not limited to, extreme weather conditions, technical failures, customs delays, etc. Additionally, please note that during periods of promotional campaigns, delivery times may be longer than usual.

NOMU uses third-party delivery services to deliver products. The delivery is considered complete when the product is delivered to the delivery address provided by the Customer or, if the Customer has chosen to pick up the product from a pickup point, when the product is made available to the Customer at the pickup point.

If the product is damaged or lost during delivery, NOMU will be responsible for the risk and costs associated with the product. The Customer must report damaged or lost products to NOMU as soon as possible, but no later than within 14 days of receiving the product. In the event of damage or loss, NOMU will provide the Customer with a replacement product or a refund.

8. Cancellation and Returns


The customer has the right to cancel the order or return the products within 14 days of receiving the product without justification, in accordance with Finnish consumer protection law. To exercise the right of cancellation or return, the customer must notify NOMU in writing within the cancellation period by contacting NOMU customer service at hello@nomufashion.com or by filling out the "Contact Us" form. The customer must include their name, address, order number, and details of the products they wish to cancel or return in the notification.

If the order has been paid for but has not yet been delivered, the customer will receive a full refund of the payment, including any shipping costs, within 14 days of notifying NOMU of the cancellation. If the order has already been delivered, the customer will receive a refund of the product price within 14 days of returning the product to NOMU or providing evidence of returning the product, whichever occurs first.

The customer is responsible for returning the product in its original condition, with all tags and labels attached, and in the original packaging. The customer must return the product without undue delay and no later than 14 days after notifying NOMU of the cancellation.

The customer is responsible for the direct return shipping costs. The customer is also responsible for any damage or loss that occurs during the return of the product, so NOMU recommends using a reliable shipping method and carefully packaging the product.

NOMU will refund the payment to the customer using the same payment method that the customer used in the original transaction, unless the customer expressly agrees to another payment method. NOMU may withhold the refund until the returned product has been received and inspected.

NOMU may deduct an amount from the refund if the product has been used or damaged or if the return does not meet the specified conditions. In such cases, NOMU will notify the customer of the deducted amount and provide evidence of the reasons for the deduction.

9. Warranty and Complaints


NOMU complies with the Consumer Protection Act's warranty regulations. The Customer has the right to file a complaint about a defect in a product within a reasonable time after discovering the defect. The Customer must file a complaint within two months of discovering the defect.

If the product has a defect covered by the warranty, the Customer has the right to request the product's repair, replacement, or a price reduction, or to cancel the contract if the defect is significant.

NOMU reserves the right to refuse to process a complaint if it is found that the product is not defective or that the defect has arisen due to incorrect use or handling of the product.

To file a complaint, the Customer must contact NOMU Customer Service at hello@nomufashion.com. The Customer must include their name, address, order number, and details of the defect in the product.

NOMU will handle the complaint in accordance with applicable laws and regulations. NOMU aims to respond to the complaint within a reasonable time, but the processing time may vary depending on the nature of the complaint.

  1. Links to external websites

The Webshop may contain links to third party websites or services. Even though the third party may be connected to NOMU, it is not possible for NOMU control these linked sites or services, as they all have their own separate and independent terms and conditions and/or privacy and data collection policies which differ from those applied by NOMU. These linked websites and services are offered only for convenience, and the Customer uses them on his/her own responsibility.

  1. Liability


NOMU is not responsible for indirect or consequential damages, such as lost profit or income, or for any damage caused by a third party, including subcontractors.

NOMU's total liability is limited to the purchase price of the product or service in question.

12. Force Majeure
NOMU is not responsible for any inconvenience or damage caused by a force majeure event, such as an interruption of NOMU's business operations, strikes, or other similar events beyond NOMU's control.

13. Personal Data
NOMU processes personal data in accordance with applicable data protection laws and its privacy policy, which is available on the Webshop. The Customer consents to the processing of their personal data as described in the privacy policy.

14. Applicable Law and Disputes
These Terms and Conditions are governed by Finnish law, excluding its choice of law provisions. Any disputes arising from these Terms and Conditions or the contract between the Customer and NOMU shall be settled in the district court of Helsinki, Finland, unless the Customer is a customer residing in the outside of Finland, in which case disputes may be settled in accordance with applicable customer protection laws.
